Terms & conditions

1.     General

1.1 The competition invites Australian residents to enter a game of chance on (“IG”), with a chance of winning prizes (“Competition”). The promoter responsible for the publication and adjudication of this Competition and the provision of the prizes is Inghams Enterprises Pty. Limited ACN 008 447 345 (the “Promoter”).

1.2 Information on how to enter this Competition forms part of these Terms and Conditions. By entering this Competition, the Entrant accepts and agrees to these Terms and Conditions and the decisions of the Promoter, which shall be final in all matters. 

1.3 The Competition is a game of chance and is only open to Australian residents who reside in Australia at the date that the Submission is made. 

1.4 Entry and continued participation in the Competition is dependent on Entrant following and acting in accordance with the instructions of the Promoter. 

1.5 The Competition starts on 12.01am AEST on 1/07/24 and closes at 11.59pm AEST on 29/07/24⁠. All references to times and dates are references to times and dates in Sydney. The Promoter reserves the right to vary the Promotional Period or to terminate the Competition at any time.  

2.     How To Enter

2.1 To submit an entry to this Competition (“Submission”), a person who enters this Competition (“Entrant”) must complete the following actions:

2.3 All Submissions must be done during the Promotional Period. Submissions received after the expiry of the Promotional Period will not be accepted. 

2.4 Any data usage fees in accessing and completing the Submission are borne by the Entrant and its parent or guardian. 

 3.     Submissions

3.1 Each Submission must be the original and sole creation of the Entrant, and all rights, title and interest including but not limited to copyright in the production works, words, and film stories contained in any Submission must be owned solely by the Entrant and/or the Entrant’s parent or guardian (and not contain any “fanfiction” or “adaptations”).

3.2 Incomplete, indecipherable, incorrect, and illegible Submissions will, at the Promoter’s absolute discretion, be deemed invalid and not eligible to win the Competition. Submissions containing offensive or defamatory comments, or which breach IG’s Terms of Use or any law, or infringe any third-party rights, including intellectual property rights, are not eligible to win the Competition. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter the Competition repeatedly is prohibited and may render all Submissions by that Entrant invalid. 

3.3 Each Submission represents solely the views and opinions of the Entrant and does not reflect the views and opinions of the Promoter in any manner. To the extent permitted by law, the Promoter expressly disclaims any and all liability in conjunction with screening, monitoring or reviewing the Submission Content (as defined below). 

3.4 Individuals can only enter once per person. 

3.5 Entrants (including shortlisted Entrants) may be required to provide proof of identity and proof of residency to verify their Submission (“Proof of Identity”).  Identification considered suitable for verification is at the Promoter’s absolute discretion. Entering the Competition under a false name may invalidate a Submission. 

3.6 The Promoter reserves the right, at any time, to verify the validity of Submissions and identity of Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who provides a Submission that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s absolute discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.  

4.     Winner Determination and Notification

4.1 There will be one person selected as the winner of this Competition (“Winner”). The Winner will be selected by the Promoter.

4.2 Winner(s) will be notified within 72 hours of the Prize Draw Date in writing by email to the email address submitted at the time of entry. 

4.3 In the event that a Winner selected through this method is disqualified, their Submission(s) is deemed invalid, or the Winner otherwise does not comply with these Terms and Conditions, the Promoter will in its absolute discretion select another shortlisted Entrant as the Winner based on chance. 

4.4 The selection of the Winners is final and binding on all Entrants – no correspondence will be entered into. 

4.5 This Competition is a game of chance; skill plays no part in determining the Winner.  

5.     Prize

5.1 The Winners will receive:

$1500 AUD Airbnb gift card 

$200 AUD Woolworths egift Card 

5.2 The Winner will receive the prize via email provided by Ingham’s. 

5.2.1 The selected winner must respond to the notification email within 48 hours of receipt, confirming that they have received the notification and accepting the prize. Failure to respond and confirm acceptance of the prize within this timeframe will result in forfeiture of the prize. In such an event, a new winner will be selected at random from the remaining eligible entries. 

5.3 The prize is not transferable, exchangeable or redeemable for cash. 

5.4 Prize/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter. 

5.5 The Winner acknowledges that the Promoter may have legitimate reasons which may require them to change the Prize fulfilment date and time. In these circumstances, the prize fulfilment date and times are subject to change with notification to the Winner. 

5.6 If the Prize (or part of the Prize) is unavailable for reasons outside of the control of the Promoter, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize of at least equal value.   

6.     Publicity and Media Participation

6.1 By entering a Submission each Entrant agrees that, if the Entrant is selected as a Winner of the Competition, the Promoter and its designated nominees may use the name, city, state, likeness, Submission and Prize information of the Winner and each shortlisted Entrant for promotional, advertising or other purposes in connection with the Competition, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without payment to, notification to, permission from or other consideration relating to the Entrant or their parent or guardian (as the case may be), except where prohibited by law.

6.2 By entering a Submission each Entrant agrees, if shortlisted as a Winner of the Competition, to participate in interviews with Australian media interviewers during the period from July 2024 to July 2024 subject to reasonable notice of such interviews being provided by the Promoter. For the avoidance of doubt, interviews can be attended in person, virtually or via a call, and the method of attendance is to be determined by the Promoter, acting reasonably, having regard to the expenses associated with attendance at the interview. Each shortlisted Entrant agrees to attend interview briefings arranged by the Promoter in preparation for the interviews. 

6.3 By entering a Submission each Entrant agrees, if selected as the Winner or as a shortlisted Entrant, to provide any additional information or materials reasonably requested by the Promoter to post on the Promoter’s digital and social platforms as well as boosted content.  

7.   Intellectual property

7.1 By entering a Submission each Entrant agrees, if selected as the Winner to grant the Promoter and its related bodies corporate a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display the images and video included in their entry. (the “Submission Content”) and all photographs, records, and other captures of their involvement in the Competition (together with the Submission Content, the “Content”) in any media or format, whether now known or later developed, for the purposes of promoting the Competition, the Promoter and its related bodies corporate, and their products.

7.2 By entering an Entrant grants a licence to the Promoter for the use and adoption of their Content for the purpose of conducting the Competition, and for their name to be posted on the Internet or any website in connection with this Competition, and the advertising, promotion, and publicity of the Competition, and otherwise, as stated in these Terms and Conditions. 

7.3 Each Entrant and their parent or guardian warrant to the Promoter that the Submission Content is an original work of the Entrant that does not infringe the rights of any third party. Each Entrant and their parent or guardian consent to any use of their Submission Content as contemplated within these terms which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).  

8.     Miscellaneous

8.1 Subject to applicable law, the Promoter reserves the right to withdraw or amend the Terms and Conditions and the details relating to the Competition as necessary due to circumstances outside its control. The Promoter will provide notice of such withdrawal or amendment.

8.2 If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its discretion, to disqualify an Entrant or to modify, suspend, terminate or cancel the Competition, as appropriate.

8.3 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any applicable statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under any applicable consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition.

8.4 Each Entrant and their parent or guardian acknowledge that, if selected as a Winner or as a shortlisted Entrant, they may be photographed, filmed, recorded or otherwise captured in any media, including but not limited for use in broadcasts, photographs, publications, internet websites, social media platforms, or other commercial, advertising or promotional materials. By entering the Competition each Entrant grants permission for their likeliness and voice to be included in such media and materials throughout the world in perpetuity without compensation, credit or other consideration.

8.5 The Promoter accepts no responsibility for Submissions that are lost, damaged, corrupted, delayed, illegal or which are unable to be submitted due to software or hardware failure or for any other reason beyond its control including unavailability of the websites.

8.6 All taxes on the Prize, if any, are the sole responsibility of the relevant Winner and their parent or guardian.

8.7 All communications with the Winners, shortlisted Entrants and other Entrants may, at the Promoter’s discretion, be conducted by the Promoter’s agents on behalf of the Promoter.

8.8 This Competition is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. The owners and operators of Facebook and Instagram are completely released from all liability by each Entrant in this Competition. Any questions, comments or complaints regarding the Competition must be directed to the Promoter and not to Facebook or Instagram.
